The services that Comtech provides to you are subject to the following Terms of Use (“TOU”). Comtech reserves the right to update the TOU at any time without notice to you. DESCRIPTION OF SERVICES.
Through its family of web sites, Comtech provides you with access to a variety of resources, including product manuals, annual reports, download areas and product information (collectively “Services”). NOTICE SPECIFIC TO SOFTWARE AVAILABLE ON THIS WEB SITE.
Any software that is made available to download from the Services (“Software”) is the copyrighted work of Comtech and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). An end user is not authorized to install any Software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms.

The Software is made available for download solely for use by end users according to the License Agreement. COMTECH DOES NOT MAKE ANY ASSURANCES WITH REGARD TO THE ACCURACY OF THE RESULTS OR OUTPUT THAT DERIVES FROM SUCH USE OF ANY SUCH TOOLS AND UTILITIES. Sie dürfen die Dienste nicht auf eine Art und Weise nutzen, die einen Comtech-Server oder das/die mit einem Comtech-Server verbundene(n) Netzwerk(e) beschädigen, deaktivieren, überlasten oder beeinträchtigen oder die Nutzung und den Genuss der Dienste durch eine andere Partei beeinträchtigen könnte. Sie dürfen nicht versuchen, unbefugten Zugang zu Dienstleistungen, anderen Konten, Computersystemen oder Netzwerken, die mit einem Comtech-Server oder einer der Dienstleistungen verbunden sind, durch Hacking, Passwort-Mining oder andere Mittel zu erlangen. Sie dürfen keine Materialien oder Informationen durch Mittel erhalten oder versuchen zu erhalten, die nicht absichtlich durch die Dienste zur Verfügung gestellt werden.

Comtech gibt keine Zusicherung, dass die Dienste für die Nutzung an Orten außerhalb der Vereinigten Staaten geeignet oder verfügbar sind, und der Zugriff auf den Inhalt von Gebieten aus, in denen ein solcher Inhalt illegal ist, ist verboten.   • Dateien hochzuladen oder anderweitig zur Verfügung zu stellen, die Bilder, Fotografien, Software oder anderes Material enthalten, das durch Gesetze zum Schutz des geistigen Eigentums geschützt ist, einschließlich, als Beispiel und nicht als Einschränkung, durch Urheberrechts- oder Markengesetze (oder durch Datenschutz- oder Publizitätsrechte), es sei denn, Sie besitzen oder kontrollieren die Rechte daran oder haben alle erforderlichen Genehmigungen erhalten, um dies zu tun.

  • das Herunterladen von Dateien, die von einem anderen Nutzer eines Kommunikationsdienstes veröffentlicht wurden und von denen Sie wissen oder wissen sollten, dass sie nicht legal vervielfältigt, angezeigt, aufgeführt und/oder verbreitet werden dürfen.
  • Fälschen oder Löschen von Informationen zur Verwaltung des Urheberrechts, wie z. B. Autorenzuschreibungen, rechtliche oder andere ordnungsgemäße Hinweise oder Eigentumsbezeichnungen oder Kennzeichnungen des Ursprungs oder der Quelle von Software oder anderem Material, das in einer hochgeladenen Datei enthalten ist.
  • Andere Benutzer in der Nutzung der Kommunikationsdienste einzuschränken oder daran zu hindern, diese zu nutzen.

  • Verzeichnisse von Nutzern der Dienste oder andere Nutzer- oder Nutzungsinformationen oder Teile davon zu verwenden, herunterzuladen oder anderweitig zu kopieren oder einer natürlichen oder juristischen Person zur Verfügung zu stellen (unabhängig davon, ob dies gegen eine Gebühr geschieht oder nicht).


Comtech has no obligation to monitor the Communication Services. However, Comtech reserves the right to review materials posted to the Communication Services and to remove any materials in its sole discretion. Comtech reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. Comtech reserves the right at all times to disclose any information as Comtech deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Comtech’s sole discretion.

Always use caution when giving out any personally identifiable information about yourself or your children in any Communication Services. Comtech does not control or endorse the content, messages or information found in any Communication Services and, therefore, Comtech specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Services. Managers and hosts are not authorized Comtech spokespersons, and their views do not necessarily reflect those of Comtech.

Materials uploaded to the Communication Services may be subject to posted limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations if you download the materials.

INDEMNIFICATION BY USER
You agree to defend, indemnify, and hold harmless Comtech and its affiliates, parents, subsidiaries, and their respective employees, agents, contractors, officers, directors, successors and assigns from all liabilities, claims, damages and expenses, including without limitation attorneys’ fees and costs, that arise from your use or misuse of the Services.

MATERIALS PROVIDED TO COMTECH OR POSTED AT ANY COMTECH WEB SITE.
Comtech does not claim ownership of the materials you provide to Comtech (including feedback and suggestions) or post, upload, input or submit to any Services. However, by posting, uploading, inputting, providing or submitting (“Posting”) your Submission you are granting Comtech, its affiliated companies and necessary sublicenses permission to use your Submission in connection with the operation of their businesses (including, without limitation, all Comtech Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; to publish your name in connection with your Submission; and the right to sublicense such rights to any supplier of the Services.

No compensation will be paid with respect to the use of your Submission, as provided herein. Comtech is under no obligation to post or use any Submission you may provide and Comtech may remove any Submission at any time in its sole discretion. By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part (“Images”), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms of Use and the Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms of Use, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images. The licenses granted in the preceding sentences for a Images will terminate at the time you completely remove such Images from the Services, provided that, such termination shall not affect any licenses granted in connection with such Images prior to the time you completely remove such Images. No compensation will be paid with respect to the use of your Images.
